Bio

Sam Bum Kim is an attorney in Kim & Chang's Antitrust & Competition Litigation, Engineering & Construction, Product Liability & Consumer Claims, and Litigation Practices. 

Before joining the firm, Mr. Kim served for two years as a judge at the Seoul Northern District Court. During his tenure as a judge, he accumulated extensive experience in a wide range of civil and criminal litigations. Through his varied experience as a judge, Mr. Kim acquired a broad and deep understanding of practicing in construction, criminal and real estate litigation. 

Aside from his role at Kim & Chang, Mr. Kim is actively involved with the local and national bar associations. At the Seoul Bar Association, he served as the Vice President and the Chair of the association’s Training Committee, as well as the lecturer of the association's Construction and Real Estate Law Training Center. At the Korean Bar Association, he is currently serving as its delegate. 

Mr. Kim received a bachelor's degree in engineering at Seoul National University and went on to graduate from the Judicial Research and Training Institute of the Supreme Court of Korea. He is a member of the Korean bar.

Construction-Related Litigations
 
  • Represented a construction company and defeated a case over liability for a failed private and public PF project involving a private consortium and a local government. 
  • Extended the period of construction in an arbitration case involving a local government turnkey project. 
  • Obtained a ruling that the right of disposition lay with the project owner (local government) in a litigation for revocation of restriction on qualification for participation in tendering procedures. 
  • Represented construction companies in a variety of preliminary injunction cases including preliminary injunctions against the suspension of tendering procedures according to public tendering procedures. 
  • Represented construction companies in a variety of cases on merits and preliminary injunction cases including those on redevelopment, nullification of the establishment of reconstruction unions, and validity of the general meeting of constructor selection. 
  • Advised on investigations and trials on a variety of safety accidents at construction sites. 
  • Advised on preliminary injunction cases during M&As. 
  • Obtained a lower court decision that registering in the G2B and restricting participation in all public tendering procedures of construction companies that are issued with a disposition of revocation of restriction on qualification for participation in tendering procedures by a public institution was against the principle of statutory reservation under the Act on the Management of Public Institutions and thus illegal. 
  • Represented construction companies and defeated many cases including a preliminary injunction against the suspension of construction against peripheral landowners. 
  • Obtained the first ruling that the contract price may exceed the expected price in the bid for technology proposal about construction documents. 
  • Obtained the first Supreme Court judgment admitting loss compensation claims due to one-sided rate reduction of competent administrative agency in private investment projects. 
  • Obtained the first judgment in the private investment business that received compensation for loss due to reduced demand, not at the fault of the operator.
