KCC Status Review of Location Information Businesses and Location-Based Services

As the competent regulatory authority (the Korea Communications Commission, “KCC”) will conduct periodic status reviews of companies’ location information business or location-based service, we hereby provide to you the following information for your reference.

Article 36 of the amended Location Information Act (“LIA”), which took effect on April 20, 2022, stipulates that periodic status reviews of location information businesses, etc., shall be conducted at least once a year.  Accordingly, the Korea Internet & Security Agency (“KISA”) plans to conduct such periodic status reviews starting this year under the guidance of the KCC and with the support of the Online Privacy Association (“OPA”).  Currently, a total of 1,135 companies are subject to such status reviews, including 291 personal location information businesses, 43 object location information businesses, and approximately 800 location-based service providers.

The status reviews will commence with the issuance of requests for information, with a submission deadline of June 10, 2022.  Thereafter, the regulatory authorities are expected to review the submitted responses to assess compliance with the technical and managerial measures under the LIA or previously submitted business plans, and make requests for supplemental submissions if violations are identified.  In addition, if the responses to such requests are insufficient, on-site inspections may be conducted.  Administrative fines of up to KRW 10 million may be imposed for non-compliance with the requests for information or the submission of false materials.
