Bio

Michael Kim is a senior foreign attorney who is a member of Kim & Chang’s Aerospace & Defense, Investment Management, Privacy & Data Security, and Insolvency & Restructuring Practices. 

As a member of the Investment Management Practice, Mr. Kim advises offshore investment management companies in connection with audits by financial regulators, regulatory licenses, and matters related to the offering and distribution of public and private funds in Korea. Mr. Kim’s financial regulatory practice has evolved to include not only investment management companies but also banks, securities companies and credit card companies. 

Mr. Kim’s practice also extends to advice on privacy and data protection-related matters for multinational companies spanning multiple industries. Mr. Kim’s experience includes compliance with ongoing regulatory requirements under the newly overhauled Personal Information Protection Act and other privacy laws as well as mitigation of a fallout from a data breach. 

Mr. Kim has advised various international defense companies in procurement transactions and disputes with various authorities including the Defense Acquisition Program Administration (DAPA) as well as the Public Procurement Service (PPS). 

Mr. Kim also has extensive experience advising foreign clients on insolvency proceedings of large Korean enterprises and on privacy and data protection issues ranging from compliance with regulations related to internal policies and consent forms to data breaches.

Previously, Mr. Kim was an in-house counsel for Fidelity Investments in Korea and is experienced in dealing with a wide range of fund-related issues, including registrations with the Financial Supervisory Service, handling and maintenance of establishment documents, and general corporate matters. 

Prior to Fidelity, Mr. Kim worked at the Industrial Bank of Korea, where he served as a treasury attorney handling and reviewing documentation for derivatives transactions executed with offshore and onshore counterparty banks.
