Bio

Kyungsun Trisha Chang is a senior foreign attorney at Kim & Chang. She practices primarily in intellectual property litigation, white collar criminal defense, corporate investigations and other regulatory matters.

Ms. Chang has extensive experience in the areas of complex, cross-border investigations and disputes involving anti-corruption, antitrust and intellectual property issues, both in the criminal and civil contexts. She regularly advises clients, including their senior managements, board of directors and special committees, on various issues throughout all aspects of investigations and disputes, including early case assessments, compliance audits and establishment of compliance infrastructures taking into account the differences between the US and Korean laws and legal systems.

With Ms. Chang’s technical background in electrical engineering, she has directed cross-border litigation and investigation strategies concerning automobiles, chemical manufacturing processes, e-commerce, electrical devices and systems, medical devices, semiconductor processing and devices, and many other technologies. 

Prior to joining Kim & Chang, Ms. Chang practiced at Paul Hastings LLP and Skadden, Arps, Slate, Meagher & Flom LLP as Of Counsel and Associate in Washington, DC and Seoul. Ms. Chang is registered to practice in New York and Washington, DC, and before the US Patent and Trademark Office. 

Ms. Chang frequently lectures on topics involving anti-corruption, corporate compliance, e-discovery and intellectual property to both in-house counsel and law firm attorneys.

  • Advised a Korean telecommunications provider in a U.S. Securities and Exchange Commission’s investigation regarding the Foreign Corrupt Practices Act (“FCPA”) and parallel proceedings involving shareholders and third parties.
  • Advised a major German automobile manufacturing group in criminal proceedings involving the Seoul Prosecutors’ Office and other authorities as well as in a criminal litigation before the Seoul District Court in relation to diesel engine compliance matters.
  • Conducted internal investigation and subsequently represented a nonprofit international public health organization relating to the FCPA and Korean anti-bribery compliance.
  • Conducted parallel internal investigations in China and Korea and subsequently represented a global medical device company concerning unfair trade practices and anti-bribery compliance.

Trade Secret
 
  • Represented a Korean conglomerate throughout a billion-dollar trade secret litigation involving civil claims with over 100 trade secrets and parallel criminal charges and anti-trust claims; all matters were globally resolved following an eight-week jury trial and successful appeal. 
  • Represented a large international fabricator in an internal investigation into the misappropriation of trade secrets allegation instigated by the US Department of Justice (trade secret; industrial silicone). 
  • Represented a semiconductor manufacturer in a trade secret lawsuit in the Superior Court of California and the Northern District of California. 
  • Represented a chemical manufacturer in a trade secret lawsuit in the Middle District of Alabama.
 
Antitrust
 
  • Represented a Korean airline company in a multi-district litigation in the Eastern District of New York relating to alleged price-fixing in the global air cargo business. 
  • Represented a Korean conglomerate in a price fixing civil litigation brought by state attorneys general in federal and state courts regarding LCD display components. 
  • Represented a Korean oil company in a price-fixing criminal investigation by the US Department of Justice.
 
Patent Litigation
 
  • Represented a global e-commerce company in patent litigation in the US Supreme Court, the US Court of Appeals for the Federal Circuit, and the Eastern District of Virginia, resulting in the Supreme Court’s landmark decision in the client’s favor that injunctions should not be presumed in patent cases. 
  • Represented a health care information technology company in patent litigation involving a patent related to medical claims auditing software in the District of Delaware, resulting in a favorable jury verdict of infringement. 
  • Represented the world’s second largest manufacturer of CDs and DVDs against the holder of standard essential patents in the US Court of Appeals for the Federal Circuit and the District of Minnesota, and obtained a critical win on a dispositive issue on appeal. 
  • Represented a semiconductor fabrication device maker in the Northern District of California in a multi-faceted, offensive patent dispute involving combined litigation, prosecution, and reexamination strategies on wafer inspection systems.
