We would like to inform you of the enforcement date of the amended data privacy laws and the status of the government's follow-up actions.
Having been passed by the National Assembly on January 9, 2020 and the Cabinet Meeting on January 28, 2020, the amendments to Korea's three main data privacy laws—the Personal Information Protection Act, the Act on the Promotion of the Use of the Information Network and Information Protection, and the Credit Information Use and Protection Act (the “Credit Information Act”)—have been promulgated on February 4, 2020. Since most of the amendments are to become effective six months from the promulgation, the amended laws will come into force on August 5, 2020 (except for certain provisions in the Credit Information Act, which will come into effect in one to one and a half year after the promulgation).
Following the passage of the amendment bills, the relevant authorities—the Ministry of the Interior and Safety, the Korea Communications Commission, the Financial Services Commission and the Personal Information Protection Commission—announced on January 21, 2020 that the relevant authorities will promptly proceed with the follow-up actions to provide for additional details and clarifications. Please refer to the attached summary of the major press releases by the government agencies so far.
More specifically, the government will (i) draft the amendments to the Presidential Decrees in February 2020; (ii) draft amendments to the lower regulations and rules in March 2020; and (iii) publish relevant guidelines and handbooks. These subsequent amendments to the subordinate regulations, guidelines and handbooks will clarify and provide necessary details to the amended data privacy laws, and therefore, it will be necessary to monitor the government's progress.
