Announcement of Second Basic Plan for Cloud Computing

  • On December 28, 2018, the ICT Strategy Committee (the “Committee”) formed by the Korean government resolved on the second basic plan for cloud computing entitled “Cloud Computing ACT Strategies for the 4th Industrial Revolution,” (the “Second Basic Plan”), which was jointly prepared by the relevant ministries.

  • The Second Basic Plan, which will be applicable from 2019 to 2021, focuses on (i) expanding the scope of the public sector using cloud services offered by private-sector companies (“private-sector cloud services”) to include central and local governments; and (ii) enhancing the competitiveness of the cloud industry in Korea.
     
    • In November 2015, the government established the First Basic Plan for Cloud Computing (applicable from 2016 to 2018), which focused on expanding the use of cloud services and enhancing the competitiveness of the cloud industry in Korea. 
    • For reference, the ICT Strategy Committee is a top-level organization in the ICT sector formed under the Prime Minister’s Office for deliberation and resolution of major policies and is composed of 25 persons, including the Prime Minister, the ministers of relevant ministries and civilian members. 
 
  • The Second Basic Plan ultimately aims to advance Korea in the top 10 global leaders in cloud computing services by 2021.  Toward this goal, the Second Basic Plan comprises three major strategies: (i) accessible data (regulatory reform); (ii) competitive platform (enhancement of competitiveness) and (iii) trustful cloud ecosystem (creation of cloud ecosystem).  Moreover, the Second Basic Plan proposes three tasks for each of the strategies and they are organized as follows:

  • Major system modifications under the Second Basic Plan are as follows:
     
    • Instead of allowing only public institutions to use cloud services, the government plans to further allow central administrative agencies and local governments to use private-sector cloud services for purposes other than national security matters and personal information processing. 
    • To this end, the government plans to cooperate with the National Assembly to amend the “Act on the Development of Cloud Computing and Protection of Its Users” and repeal the “Guideline on Use of Private-sector Cloud Services by Public Institutions” in order to specify the grounds and requirements for the use of private-sector cloud services by law.  Furthermore, the government plans to incorporate private-sector cloud usage procedures and standards for ensuring safety in the “Electronic Government Act” and further specify the target information and usage standards (e.g., security, performance, costs) under the direction of the Ministry of the Interior and Safety. 
    • The government plans to amend the “Act on Contracts to which the State is a Party” to improve the state contract system, which currently focuses on purchase of goods and service orders, so that the system becomes suitable for the use of cloud services.  The government also plans to improve the distribution platform which provides information for selection of services and supports contract system suitable for cloud services. 
    • In addition, the government has already expanded the scope of application of “Cloud Service Security Certification System,” which had been previously implemented for Infrastructure as a Service (IaaS) in May 2016, to Software as a Service (SaaS) in July 2018.  By extending operation of the certification system, the government plans to enable public institutions to use cloud services whose safety and reliability have been verified.
