Kyung Yoon Lee, a senior member of Kim & Chang’s M&A Practice, participated as a panel speaker at a workshop hosted by the United Nations Commission on International Trade Law (the “UNCITRAL”) on August 31, 2022 during the Singapore Convention Week.

At this workshop, the panel, including Mr. Lee, discussed key issues related to the main topic, “Midnight clauses and S.M.A.R.T. settlement agreements: tackling delay, confidentiality and enforceability.”  Comprised of practitioners from civil and common law jurisdictions, the panel shared practical tips to advise clients in order to achieve outcomes to the satisfaction of both parties.

In particular, Mr. Lee shared behind-the-scenes experiences regarding resolving complex disputes in multiple jurisdictions by one single settlement through a mediation.  Also, based on his recent experience in a mediation case, Mr. Lee emphasized the necessity of proactively utilizing mediation prior to or even during the arbitration for efficient dispute resolution for the benefit of the parties involved.
