Kim & Chang secured a favorable decision for Apacs Sports, a well-known badminton racket manufacturing company in Malaysia, against a civil complaint seeking compensation for damages.

The plaintiff was a local importer that argued that Apacs Sports supplied its products to other companies in Korea in violation of an exclusive distribution agreement. 

By diving into the specific facts and evidence of the case, Kim & Chang was able to work with the client to prove that third parties had simply imported badminton rackets through a different channel and that there were no facts to support that Apacs Sports had violated the exclusive distribution agreement.  Agreeing with our arguments, the court dismissed the civil action initiated by the plaintiff.
