In this year’s edition of our Compliance Outlook newsletter, we first look at the impact of the current political situation as well as the potential impact of President Trump’s trade policies, on the corporate regulatory environment in Korea. We then review several major trends affecting corporate compliance, including the changing concept of director fiduciary duties and the impact of AI on corporate compliance. On a related issue, we also review how the uncertain political/economic environment has shaped how companies respond to corporate investigations.

Moving to the realm of public enforcement, we review recent developments with regards to the investigative powers of the Police and the Prosecutors’ Office, arising from the general trend of a shift in investigation authority from the Prosecutors Office to the Police. Finally, we review how the above shift has also coincided with certain regulatory agencies receiving a higher profile, now being endowed with authority to conduct their own criminal investigations.
