The aforementioned cases will be the first en banc decisions by the Supreme Court pertaining to the ordinary wage issue since the 2013 en banc decision in which the Supreme Court confirmed that a regular bonus should be sufficiently “fixed” to be treated as ordinary wage. Whether the Supreme Court will make any changes to this “fixed” requirement and any of its other positions pertaining to the ordinary wage issue is a key focus point.
