Kim & Chang and the Korea Chamber of Commerce and Industry (the “KCCI”) jointly hosted a seminar titled “Types of ESG Disputes and Dispute Resolution Methods for Risk Management - Litigation, Arbitration and Mediation” on November 7, 2022.  The Korean Society on International Construction & Energy Law sponsored the event.

The event started with opening remarks delivered by Tae-Hee Woo, the Vice-Chairman of the KCCI, and consisted of two sessions.  Byung-Chol (B.C.) Yoon, from our firm’s International Arbitration & Cross-Border Litigation Practice, moderated both the first and second sessions.  Each session included one presenter and two panel members.

In the first session, Sangwoo Kim from our ESG Practice, introduced aspects regarding ESG disputes that may arise in and out of Korea.  The panel members, Joon Hyug Chung from Seoul National University and Hye Sung Kim from our International Arbitration & Cross-Border Litigation Practice, discussed detailed examples of new types of disputes that Korean companies have been facing while conducting business worldwide and suggested that preparatory measures regarding ESG disputes should be taken by Korean companies.

In the second session, Sae Youn Kim from our International Arbitration & Cross-Border Litigation Practice, introduced how to address corporate risks concerning ESG disputes through various dispute resolution methods such as litigation, arbitration and mediation.  The panel members, Kyu-Chol Chung, the Vice-President of SK Ecoplant, and Una Cho, a senior foreign attorney from our International Arbitration & Cross-Border Litigation Practice, introduced successful dispute resolutions precedents on ESG-related matters, and provided tips for risk-hedging in the contract negotiation stage.
