KIPO Introduces Expedited Examination for Inventions Related to the "Fourth Industrial Revolution"

|
The Korean Intellectual Property Office (KIPO) has announced that under the revised Enforcement Decree of the Korean Patent Act (effective on April 24, 2018), expedited examination will be available for patent applications related to "fourth industrial revolution" (4IR) technologies such as artificial intelligence, internet of things, 3D printing, autonomous vehicles, cognitive robotics, Big Data and cloud computing.

This is a continuation of recent patent policies relating to 4IR technologies, which KIPO began last year. Under this new program, a patent application for a 4IR-related invention can qualify for expedited examination if the following conditions are satisfied:

|
(i) |
the applicant conducts a prior art search and submits the results to KIPO; and |
(ii) |
the patent application belongs to the seven technology categories relating to 4IR. |
|
|
|
|
Expedited examination under this new program would reduce the total pendency of the examination to about 6 months, which is about one third the average time required for a normal examination. Since there is no restriction on the nationality of eligible applicants, foreign entities also can file petitions for expedited examination under this program, assuming the above conditions are met.
